In a significant judgment (FAO 167/2025; Neutral Citation: 2025:DHC:5015), the Delhi High Court has reaffirmed that employers cannot restrict former employees from joining new roles—even with clients or associates of their previous employer.
The ruling in Varun Tyagi vs. Daffodil Software Pvt. Ltd., delivered by Hon’ble Justice Tejas Karia on 25 June 2025, strongly emphasized that “an employee cannot be confronted with the situation where he has to either work for the previous employer or remain idle.”
The case involved software engineer Varun Tyagi, who transitioned to Digital India Corporation—a government body overseeing the POSHAN Tracker project—after resigning from Daffodil Software.
